Auren RX Consent to Telehealth Services

PLEASE READ THIS CONSENT TO TELEHEALTH SERVICES ("Consent") CAREFULLY BEFORE USING THE AUREN RX PLATFORM TO ACCESS HEALTH CARE SERVICES.
BY CLICKING "I AGREE," CHECKING THE BOX ACKNOWLEDGING THIS CONSENT, OR OTHERWISE PROCEEDING WITH AN ONLINE VISIT OR CONSULTATION, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS CONSENT, UNDERSTAND THE RISKS AND BENEFITS OF TELEHEALTH SERVICES, AND PROVIDE YOUR INFORMED CONSENT TO RECEIVE HEALTH CARE SERVICES VIA TELEHEALTH UNDER THE TERMS DESCRIBED BELOW.
This Consent supplements, and is incorporated by reference into, the Auren RX Terms of Use and Privacy Policy. Capitalized terms not defined herein have the meanings given in the Terms of Use.
1. Introduction
Hades Capital LLC, doing business as Auren RX ("Auren RX," "we," "us," or "our"), operates a technology platform (the "Platform") that connects users with licensed health care providers employed or contracted by Beluga Health, P.A. and similar affiliated professional medical entities (collectively, "Providers"). Auren RX is not a medical practice and does not itself provide medical care. All clinical services are rendered by the Providers, who are independently licensed health care professionals.
This Consent describes what telehealth is, the services that may be delivered through the Platform, the risks and benefits of telehealth, and your rights as a patient.
2. What is Telehealth?
Telehealth (also referred to as telemedicine) is the delivery of health care services using electronic communications, information technology, or other electronic means between a health care provider and a patient who are not in the same physical location. Telehealth services delivered through the Platform may include, without limitation:
- Asynchronous ("store-and-forward") communications, in which you and your Provider exchange information at different times, such as through online questionnaires, secure messaging, photographs, or uploaded documents.
- Synchronous communications, in which you and your Provider interact in real time via audio, video, or other live communications technology.
- Electronic transmission of medical records, photo images, lab results, or other health information between you and your Provider.
- Electronic prescribing of medication to a pharmacy of your choice or a pharmacy in the Auren RX Pharmacy Network.
- Follow-up monitoring and ongoing care between you and your Provider through the Platform.
3. Services You May Receive
Through the Platform, you may receive services including, but not limited to:
- Medical evaluation, assessment, and diagnosis
- Treatment recommendations and the development of a personalized care plan
- Prescription of medication, when clinically appropriate, including medications for weight management
- Ongoing clinical care, including secure messaging with your Provider and periodic clinical check-ins as medically necessary
- Referrals to in-person care or other specialists when appropriate
- Coordination with pharmacy services for the dispensing of prescribed medication
4. Benefits of Telehealth
The expected benefits of receiving care via telehealth include:
- Improved access to health care, including for individuals in locations where certain specialists may not be readily available
- Greater convenience and the ability to receive care without traveling to a physical office
- More efficient evaluation, diagnosis, treatment, and follow-up
- Reduced wait times and the ability to communicate with your Provider asynchronously
5. Risks and Limitations of Telehealth
As with any form of medical care, there are potential risks and limitations associated with telehealth, including:
- Limitations of remote evaluation. Your Provider will not be able to physically examine you in person. As a result, your Provider may not have access to information that would otherwise be obtained through a physical examination, and certain diagnoses or treatment decisions may be limited, provisional, or not appropriate for telehealth.
- Information you provide. The quality and accuracy of the care you receive depends substantially on the completeness and accuracy of the information you provide. If you do not provide complete and accurate information, including your full medical history, current medications, supplements, allergies, and symptoms, your Provider may not be able to provide appropriate care, and adverse outcomes, drug interactions, or allergic reactions could result.
- Technology limitations. Delays, interruptions, poor data quality, or other technical issues may affect the delivery of telehealth services. Equipment failures, internet outages, or other connectivity issues may delay evaluation, treatment, or follow-up.
- Security and privacy. Although Auren RX and its Providers use commercially reasonable safeguards to protect your information, no electronic transmission is completely secure. There is a risk, however small, that protected health information transmitted electronically could be intercepted or accessed by unauthorized parties. Text messages and emails exchanged with Auren RX or your Provider are not encrypted.
- Not appropriate for all conditions. Telehealth is not appropriate for every medical condition. Your Provider may determine that your condition cannot be safely or appropriately evaluated or treated via telehealth and may refer you for in-person care.
- No guarantee of diagnosis, treatment, or prescription. Receiving a telehealth consultation does not guarantee that you will receive a particular diagnosis, treatment, or prescription. All clinical decisions are made by your Provider in his or her independent professional judgment.
6. Emergency Services — IMPORTANT
THE AUREN RX PLATFORM AND ITS PROVIDERS DO NOT PROVIDE EMERGENCY MEDICAL SERVICES. THE PLATFORM IS NOT MONITORED 24/7. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM IMMEDIATELY.
If you experience any urgent or emergent symptoms, including but not limited to chest pain, difficulty breathing, severe abdominal pain, thoughts of self-harm or suicide, severe allergic reaction, or any other condition you reasonably believe requires immediate medical attention, you should seek emergency care immediately and not rely on the Platform.
7. Weight Management and Prescription Medication
If you receive care through Auren RX's Weight Management Program or any other program involving prescription medication, you acknowledge and understand the following:
- Clinical eligibility. Your eligibility to receive prescription medication is determined by your Provider based on clinical criteria. Not all users will be eligible. Meeting any general program criteria does not guarantee that you will be prescribed medication.
- Compounded medications. Some medications prescribed through the Platform may be compounded by a licensed compounding pharmacy. Compounded medications are not approved by the U.S. Food and Drug Administration ("FDA") in the specific compounded form, and the FDA does not verify the safety, effectiveness, or quality of compounded drugs in the same way it does for commercially available FDA-approved products. Compounded medications are prepared based on a prescription from your Provider for a specific patient. If a compounded medication is prescribed to you, your Provider will discuss the reasons with you and you may decline.
- Side effects and risks. All medications carry potential side effects and risks. Your Provider will discuss the specific risks, benefits, and side effects of any prescribed medication with you. You are responsible for reviewing all medication labeling, patient information, and instructions, and for contacting your Provider promptly if you experience any adverse effects.
- Off-label use. In some cases, medications may be prescribed for uses that have not been specifically approved by the FDA ("off-label" use). Off-label prescribing is legal and common in medical practice when supported by clinical judgment.
- Ongoing monitoring. Treatment with weight management medication generally requires ongoing monitoring. You agree to engage in good faith with follow-up care, including responding to messages from your Provider, completing requested check-ins, and reporting any concerning symptoms.
- Lifestyle factors. Medication is one component of weight management. Sustained results typically require accompanying lifestyle changes, including diet, physical activity, and behavioral modifications. Your Provider may recommend such changes as part of your care plan.
- No guaranteed outcomes. Individual responses to medication and treatment vary. No specific weight loss, health outcome, or treatment result is promised or guaranteed.
8. Your Rights and Acknowledgments
You acknowledge and agree to the following:
- Voluntary participation. Your participation in telehealth services through the Platform is voluntary. You have the right to decline telehealth services at any time and to seek in-person care instead, without affecting your right to future care.
- Withdrawal of consent. You may withdraw this Consent at any time by notifying Auren RX in writing at Support@AurenRX.Com. Withdrawal will not affect any care already provided or any obligations already incurred.
- Same privacy rights. You have the same privacy rights with respect to telehealth services that you would have during an in-person visit. Information about you and your care will be handled in accordance with the Auren RX Privacy Policy and the applicable Provider's Notice of Privacy Practices.
- Medical record. All information you submit through the Platform, and all clinical notes and communications entered by your Provider, will become part of your medical record. You may request a copy of your medical record by emailing Support@AurenRX.Com.
- Provider licensure. Your Provider is licensed to practice in the state in which you are located at the time of your visit. If you relocate or travel to a different state, your Provider may not be able to continue providing care to you in that location.
- Communications. You expressly consent to allow Auren RX and your Provider to contact you by telephone, email, text message (SMS/MMS), or in-app message regarding your care, appointments, billing, and other matters related to the Services, using the contact information you have provided. Standard message and data rates may apply. You may opt out of marketing communications at any time as described in the Privacy Policy.
- Disclosure of medical information. You understand that your health information may be shared with other individuals and entities as described in the Privacy Policy and the applicable Notice of Privacy Practices, including:
- Pharmacies and laboratories involved in your care
- Other treating providers, with your consent or as permitted by law
- When required by valid court order or other legal process
- To report suspected abuse, neglect, or domestic violence
- To prevent or reduce a serious and imminent threat to the health or safety of any person
- No provider-patient relationship with Auren RX. Auren RX is a technology company, not a medical practice. Your provider-patient relationship is exclusively with your Provider and the affiliated professional medical entity that employs or contracts with him or her.
9. Consent to Asynchronous Communications
You specifically consent to receive care through asynchronous (store-and-forward) telehealth, which may include exchanging photographs, video, audio recordings, written messages, questionnaire responses, and other information with your Provider at different times. You understand that your Provider may make clinical decisions, including issuing prescriptions, based on asynchronous review of your submitted information without a real-time interaction.
10. Acknowledgment and Agreement
By clicking "I Agree," checking the box acknowledging this Consent, or otherwise proceeding with a telehealth visit through the Platform, you confirm that:
- You have read and understand this Consent in its entirety;
- You have had the opportunity to ask questions about telehealth, the Services, and this Consent, and any questions you have asked have been answered to your satisfaction;
- You understand the risks, benefits, and limitations of telehealth as described above;
- You are at least 18 years of age;
- You are physically located in a state where Auren RX and its Providers offer Services;
- You voluntarily consent to receive health care services via telehealth through the Platform; and
- You have the legal capacity to provide this Consent.
